Negotiated Rulemaking Committee Reaches Consensus on New Program Accountability Framework

In January 2026, the U.S. Department of Education’s negotiated rulemaking committee on Accountability in Higher Education and Access Through Demand-driven Workforce Pell (AHEAD) reached consensus on a new federal framework for program-level accountability.

The agreement establishes the foundation for the Student Tuition and Transparency System (STATS), which is expected to replace the current Financial Value Transparency and Gainful Employment (FVT/GE) framework beginning in 2027, pending completion of the federal rulemaking process.

A New Direction for Federal Accountability

The consensus reflects a shift toward a more unified approach to program accountability, expanding beyond the current structure that applies primarily to gainful employment programs.

Under the framework approved in committee, accountability measures would apply more broadly across programs participating in Title IV federal student aid. The model emphasizes graduate earnings outcomes relative to benchmark measures, aligning with broader federal efforts to provide clearer information about postsecondary program value.

Alignment with Federal Policy Priorities

The framework reflects statutory changes enacted through the One Big Beautiful Bill Act (OBBBA) in July 2025, which introduced a “do no harm” standard tied to program-level outcomes. The committee’s consensus represents an effort to translate that statutory direction into a single accountability system.

Transition from FVT/GE to STATS

While the new framework moves through the formal rulemaking process, institutions should continue preparing for one final FVT/GE reporting cycle, scheduled to open July 1, 2026, with a submission deadline of October 1, 2026.

Following that final cycle, a transition to STATS is anticipated beginning in 2027, subject to completion of the federal rulemaking process.
